Terms of Service

Article 1 — Purpose

These Terms of Service (hereinafter “Terms”) define the terms and conditions of use of the services offered by BH EURL, publisher of the TrustAkt brand, through its various software applications accessible as SaaS (Software as a Service).

The applications include:

• Gantt by TrustAkt — Project management and Gantt charts
• Kontrakt by TrustAkt — Subcontractor compliance and document tracking
• Voodoo BTP by TrustAkt — Construction industry ERP
• Claimvault by TrustAkt — Product claims evidence vault
• Konvertor by TrustAkt — Document conversion and transformation

Any use of the services implies full and unreserved acceptance of these Terms.

Article 2 — Definitions

• Publisher: BH EURL, publisher of the TrustAkt brand.
• Platform: all software applications published under the TrustAkt brand.
• User: any natural or legal person accessing the Platform.
• Account: the User’s personal space, created upon registration.
• Data: all information entered, imported, or generated by the User on the Platform.
• Subscription: a paid plan giving access to the full features of one or more applications.

Article 3 — Acceptance of Terms

Use of the Platform is subject to prior acceptance of these Terms. The User declares having read the Terms and accepts them without reservation. The Publisher reserves the right to modify the Terms at any time. Modifications take effect upon publication at trustakt.com/terms.

Article 4 — Registration and user account

Access to certain features of the Platform requires the creation of an Account. The User agrees to provide accurate information and to keep it up to date.

Authentication may be performed via:

• Email address and password
• Magic link
• Third-party provider (Google, GitHub, etc.)

The User is solely responsible for the confidentiality of their credentials. Any use of their Account is deemed to have been made by them.

Article 5 — Description of services

The TrustAkt Platform offers a set of industry-specific software applications accessible online. Each application may be subscribed to individually or as part of a suite (bundle).

Services include, depending on the subscribed application:

• Project management (planning, Gantt charts, critical path)
• Monte Carlo simulations and risk analysis
• Earned Value Management (EVM)
• AI-generated narrative reports
• Contract management, documents, and deadlines
• Product claims evidence vault (cosmetics, organic, regulatory compliance)
• Industry ERP (accounting, invoicing, CRM, inventory)
• Document conversion and transformation
• Multi-format export (PDF, DOCX, CSV, PNG)
• Cloud sync and multi-device access

The Publisher reserves the right to modify features, add new ones, or remove existing ones, without prior notice.

Article 6 — User obligations

The User agrees to:

• Use the Platform in accordance with its intended purpose and applicable laws.
• Not attempt to compromise the integrity, security, or availability of the Platform.
• Not use the Platform to distribute unlawful, defamatory, or objectionable content.
• Not systematically extract data (scraping).
• Respect the intellectual property rights of the Publisher and third parties.

Article 7 — Liability

The Publisher endeavors to ensure the availability and proper functioning of the Platform, without however guaranteeing continuous and uninterrupted availability.

The Publisher shall not be held liable for any direct or indirect damages resulting from the use or inability to use the Platform, including data loss, service interruption, computer viruses, or failure of any telecommunications system.

In any event, the Publisher’s liability is limited to the amounts actually paid by the User during the twelve (12) preceding months.

Article 8 — Intellectual property

The Platform, its architecture, source code, graphic elements, and content are the exclusive property of the Publisher or its licensors and are protected by French and international intellectual property laws.

The User retains ownership of all Data they enter, import, or generate on the Platform. The Publisher undertakes not to use such data for any purpose other than providing the service.

Article 9 — Personal data

The processing of personal data is described in the Privacy Policy. Cookie management is detailed in the Cookie Policy.

Article 10 — Pricing and payment

Some applications offer a free trial period. At the end of this period, access to full features requires a paid Subscription.

Payments are processed by Paddle (Merchant of Record). Prices are displayed including applicable taxes (VAT).

The Publisher reserves the right to modify its pricing. Any modification will be notified to the User at least 30 days before it takes effect. The User may cancel their Subscription before the new pricing applies.

Article 11 — Duration and termination

The Subscription is entered into for an indefinite period, with a monthly billing cycle. The User may cancel their Subscription at any time from their personal space. Cancellation takes effect at the end of the current billing period.

Upon cancellation, the User has 30 days to export their Data. After this period, Data may be deleted.

The Publisher reserves the right to suspend or terminate a User’s Account in case of breach of these Terms, without prejudice to any damages.

Article 12 — Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or execution shall be submitted to the exclusive jurisdiction of the courts of Paris, unless otherwise required by mandatory legal provisions.

Article 13 — Contact
